Disclosure of Notes – LCN September 2026

The meeting first considered when we might need to disclose client notes. We considered requests directly from the client and/or requests from a solicitor.

There was a discussion on how the information might be used. Whether it be harmful or helpful to the client, if it were third-party information (and what this might be), and if there was an entry in the notes about a consultation in counsellors supervision.

Finally, there was consideration of how GDPR was relevant to record keeping and the disclosure of notes and other information, and the time limits involved which may affect later requests for disclosure.
